MusicEDU Privacy Policy
MusicEDU is committed to protecting your privacy. MusicEDU uses your Personal Data to maximise the services that it provides.  MusicEDU respects the privacy of the Personal Data provided by you and adheres to applicable privacy and data protection laws and regulations.  Please read the following Privacy Policy so you understand how your Personal Data will be used.

DEFINITIONS

Personal Data means all information relating to an identified or identifiable individual, including names, physical addresses, email address, phone number, preferences, feedback and suggestions, IP addresses, location data, financial information and related personal information.

MusicEDU means MusicEDU Pty Ltd  ABN: 74 150 741 076 or its related bodies corporate. 

APPLICATION
This Privacy Policy applies to all Personal Data processed by MusicEDU including all Personal Data you submitted.

This Privacy Policy does not apply to the practices of companies that MusicEDU does not own or control, or to individuals whom MusicEDU does not employ or manage, including any of the third parties to which MusicEDU may disclose your Personal Data as set forth in this Privacy Policy.

CONSENT TO MUSICEDU’S PRIVACY POLICY
By submitting Personal Data, which includes registering a product, an individual agrees with the terms of MusicEDU’s current Privacy Policy. If an individual does not agree with any term within this Policy, then Personal Data should not be provided. You are not obligated to provide MusicEDU with your Personal Data, however, failure to provide Personal Data may result in MusicEDU being unable to provide you with product(s) and/or provide certain services including after sales service.

COLLECTION OF PERSONAL DATA AND OTHER INFORMATION
MusicEDU collects and process Personal Data and other information for the following purposes:

  • To register a product warranty;
  • To perform authorised financial transactions as part of the purchase of a product or service;
  • To provide a personalised service;
  • To analyse and evaluate our users use of MusicEDU’s website;
  • To improve products and websites;
  • For directly marketing to you;
  • To protect MusicEDU’s legal interests and fulfil its regulatory obligations;
  • To respond to enquiries, feedback or complaints received from you;
  • On an aggregated non-identifiable basis, to:
    1. Help MusicEDU understand its market position; and

  • In other circumstances, provided MusicEDU complies with applicable Data Protection laws and regulations;

MusicEDU will not collect any Personal Data unless an individual provides this information voluntarily.  By providing MusicEDU with your Personal Data, you are authorising MusicEDU to use that information in accordance with this Privacy Policy. 

DISCLOSURE OF PERSONAL DATA
MusicEDU will not sell your Personal Data to anyone.

MusicEDU may share your Personal Data with other brands or entities within the MusicEDU Group. 

MusicEDU may at its discretion engage third parties to provide services on its website or for its business processes, including to process and analyse data collected. MusicEDU may share your Personal Data as necessary for the third party to provide the service. MusicEDU limits the information it provides to third parties to the information they need to provide the service. MusicEDU deals with third parties that are required to meet the privacy standards described in this Policy in handling your Personal Data. 

If a product or service is ordered from MusicEDU, then Personal Data may be shared with MusicEDU’s suppliers and other third parties to allow delivery of such product or service.  These suppliers and other third parties are only authorised by MusicEDU to use Personal Data for the purpose it is given.

MusicEDU may from time to time need to disclose certain information, which may include your Personal Data, to comply with a legal requirement, such as a law, regulation, court order, subpoena, warrant, in the course of a legal proceeding or in response to a law enforcement agency request.  MusicEDU may also use your Personal Data to protect the rights, property or safety of MusicEDU, our customers or third parties.

 If there is a change of control in one of our businesses (whether by merger, sale, transfer of assets or otherwise) customer information, which may include your Personal Data, could be disclosed to a potential purchaser under a confidentiality agreement. We would only disclose your information in good faith and where required by any of the above circumstances. 

STORAGE AND SECURITY OF YOUR PERSONAL DATA
Personal Data stored in MusicEDU’s system is protected by electronic and procedural safeguards. We take reasonable precautions to protect Personal Data (and other content) from accidental loss and theft by storing it in secure data centres. Communication between users and our servers is encrypted via industry-standard secure sockets layer (SSL).

In relation to website security, the website is protected with a SSL Certificate. An SSL certificate serves as a digital “passport” that allows data to be transmitted over secure networks — protecting financial and credit card transactions, signups, web access to mail, sensitive information and intranets. It authenticates and encrypts the data transferred through the website to the server.

We take all reasonable steps to protect Personal Data, including through internal and external security, restricting access to Personal Data to those who have a need to know, maintaining technological products to prevent unauthorised computer access and regularly reviewing our technology to maintain security. Credit card information is not stored by MusicEDU on its servers. We choose technology partners based on their security and privacy policies and practices.

Given internet transmissions cannot be guaranteed to be entirely secure, you acknowledge and agree that you use the website and MusicEDU’s services is at your own risk.

In case of a Security incident or any other breach of security safeguards, such as unauthorised disclosure of Personal Data under MusicEDU’s control, MusicEDU will respond in accordance with applicable Data Protection Laws.

RETENTION AND DELETION OF PERSONAL DATA
MusicEDU will retain your Personal Data for as long as it needs to provide you with its services.

MusicEDU takes steps to regularly destroy Personal Data, however it may:

  1. a) in some cases, retain a copy of your Personal Data to comply with our legal obligations, resolve disputes, enforce our agreements and to comply with our trust and safety obligations. Personal Data retained for this purpose will be archived and stored in a secure manner and will not be accessed unless required for any of these reasons; and
    (b) retain Personal Data in an aggregated, de-identified or anonymous or other form where there is no reliable way of identifying you from the information. MusicEDU is free to use and reproduce any such information freely, and for any purpose 

COOKIES
A cookie is a small file placed in your web browser that collects information about your web browsing behaviour.  Use of cookies allows a website to tailor its configuration to your needs and preferences. Cookies do not access information stored on your computer or any Personal Data. Most web browsers automatically accept cookies, but you can choose to reject cookies by changing your browser settings.  This may, however, prevent you from taking full advantage of our website.

Our website uses cookies to analyse website traffic and help us provide a better website visitor experience.  In addition, cookies may be used to serve relevant ads to website visitors through third party services such as Google AdWords.  These ads may appear on this website or other websites you visit.  

TRANS-BORDER PERSONAL DATA FLOWS
MusicEDU is a globally connected business and therefore stores and processes Personal Data gathered on servers located in other countries.

Some of your Personal Data may be disclosed to overseas recipients. Where we transfer your Personal Data to related entities outside Australia, we believe that the recipients of such information are subject to a law, binding scheme or contract which effectively upholds principles for fair handling of the information that are similar in all material respects to the Australian Privacy Principles outlined in the Privacy Act 1988 (Cth).

Please be advised that through your continued use of MusicEDU’s website and services, which are governed by NSW law, you are transferring your Personal Data to Australia and you expressly consent to that transfer and consent to be governed by NSW law for these purposes. All teacher and student data gathered for the purposes of using The MusicEDU Suite, are held on a server located in Victoria, Australia.

YOUR RIGHTS
You have the right to:
(a)    access and correct your Personal Data that is held by us at any time.
(b)    request the erasure of any or all of your Personal Data;
(c)    restrict or object to the processing of any or all of your Personal Data; and
(d)    withdraw any consent to processing that you have previously given in respect of any or all of your Personal Data.

CHANGE IN PRIVACY POLICY
MusicEDU will review and amend this Privacy Policy to ensure it remains current. MusicEDU may modify this policy at any time, in its sole discretion and all modifications will be effective immediately upon MusicEDU posting the updated Privacy Policy on this website.  Please return periodically to review the Privacy Policy.
